THE COUNTY OF PAGE, VIRGINIA (COUNTY) EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY TYPE, UCC OR OTHERWISE, EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, ANY WARRANTY AS TO THE ACCURACY OF THE DATA, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE.
The data is used for internal purposes by the County and the County assumes no responsibility to maintain the data in any particular manner or form. The data is subject to constant change and its accuracy cannot be guaranteed. Errors or omissions are possible and user is hereby advised of that possibility. This data should not be considered authoritative for navigational, engineering, legal, or other site-specific uses.
The County disclaims any and all responsibility and shall not be held liable for any claims, causes of action or damages of any type or nature arising out of, or in any way connected with, the data or the use or performance thereof. This includes, but is not limited to, any claims, causes of action, or damages for costs of recovering, reprogramming, or reproducing any programs or data use with or stored with the GIS data, damage to property, damages for any personal injuries or wrongful death, or damages for any lost data, lost profits, lost savings, or any other special, direct, indirect, consequential, or punitive damages.
The user and/or entity obtaining the data agree to hold the County, its Board of Supervisors, officers, employees and agents harmless from, and to indemnify them for, any and all claims, causes of action, or damages of any type or nature arising out of or connected in any way with the data obtained or the use or performance thereof.
The data provided by the County shall remain the property of the County, which retains all rights commensurate with ownership, including the right to sell, release, license, use or provide the data to others as it deems appropriate in its sole discretion and the copyright to the data and the form in which it is compiled and presented.
The user acknowledges and agrees that the County is not required by law to abstract or summarize GIS data or convert GIS data from one format to another not regularly used by the County for such data.
The following clause shall appear on all drawings, maps or plans created by other than County personnel or County consultants or contractors through the use of this data:
"The information displayed is a compilation of records, information, and data obtained from various sources, including the County of Page, which is not responsible for its accuracy."
User acknowledges the request of the County for the user to notify the County of any errors or omissions in the data and user will make reasonable efforts to notify the County's Assessors Office of any such errors or omissions user might discover.
If any part of the terms and conditions of this Notice are held to be invalid or unenforceable by a court of competent jurisdiction, the remaining terms and conditions shall not be affected and all other terms and conditions shall be valid and enforceable to the fullest extent permitted by law. The user and/or entity obtaining the data agree to, and do hereby submit themselves to, a court of competent jurisdiction in the County of Page, Virginia, and agree that this notice is controlled by the laws of the Commonwealth of Virginia and that all claims, disputes, and other matters involving the County and this Notice and/or the data shall only be heard and decided by such court.
